US Department of Justice sues SpaceX for hiring discrimination

Even if the U.S. law does not require it, I would expect technology companies to do some serious background checking for any applicants, and that would be much harder to do for people whose prior situation led them to seek asylum, or even immigrate legally from other countries. Spying is a real activity, performed not only by foreign governments, but also by competing companies, even within the same country. And actual sabotage is not out of the question among competing national entities.

So, with respect to the conflicting statements made by the government and SpaceX, maybe this will settle once and for all whether SpaceX can hire Canadians.

But, who exactly are the legal non-citizen residents who want to work for SpaceX and are not being accepted? It seems to me that there need to be some in order for any legal case to have "standing" for a lawsuit.

Note that the government agency is "suing" instead of "fining". That indicates some lack of clarity that the government has a real case.
